Terms

These terms are the agreement between your business and Local Works Labs Ltd, trading as LocalMotor (“we”, “us”), a company registered in England and Wales, company number 17527661. They apply when you create a LocalMotor account. You must be setting up the account for a business, and have authority to agree on its behalf. These terms are for businesses, not consumers.

1. What LocalMotor does

1. We build and host a website for your business, using details from your Google Business Profile and anything you add or change.
2. We give you a web address on localmotor.co.uk, and optionally your own address (a paid add-on, see 4).
3. Your website can take messages and booking requests from your customers. We pass each one to you by text or email. Nothing is booked until you confirm it. You decide whether to accept a request, offer another day, or call the customer.
4. Depending on what you switch on, we can send your customers texts on your behalf: confirming what you agreed, and reminding them when an MOT or service is due.
5. We show you how your website is doing: visitors, where they came from, calls, directions and requests. We count these without cookies.
6. You manage all of this from your dashboard.

We may improve or change features over time. If a change takes away something you rely on, we will tell you at least 30 days before.

2. Your account

• Keep your sign-in details safe. You are responsible for what happens under your account.
• One account is for one business. Tell us if your business details change.
• You can add or change your mobile number and email for alerts in Settings.

3. Your content and your customers

• Your content stays yours. That means your name, logo, photos, descriptions, prices and opening hours. You give us a licence to host, display and adapt it (for example, resize photos) only to run your website and the service.
• You must have the right to use anything you upload, including photos and logos.
• Information from Google. We may start your website with details and photos from your public Google Business Profile, with credit to Google where required. Your Google rating is shown live from Google and not stored by us. You can remove or replace any of it.
• Your customers’ details belong to you. When customers contact you through your website, you are responsible for them under data protection law, and we handle their details for you under the Data processing terms.
• You must not use LocalMotor to send marketing your customers have not agreed to receive. Reminder texts must relate to work you have done or agreed to do for them.
• Your prices, services and the work you do are your responsibility. We are not party to any agreement between you and your customers.

4. Price and payment

• Free period. New accounts are free for 4 months from sign-up. No card is needed to start.
• After that, £19 a month [plus VAT if applicable], billed monthly in advance. We will remind you before your free period ends, and you only pay if you choose to carry on.
• Own web address (paid add-on). If you buy a web address through us, it is registered in your business’s name and stays yours if you leave. We renew it each year and remind you a month before renewal. The price is shown before you buy. Those purchases also follow the web address terms.
• We may change prices with at least 30 days’ notice. A new price applies from your next billing date after the notice ends.
• If a payment fails, we will let you know and try again. If it is still unpaid after 14 days, we may pause your website until it is paid.

5. No contract term, and leaving

• There is no minimum term. Cancel any time from Settings, and your plan ends at the end of the month you have paid for. We do not refund part months.
• When you leave, your website goes offline. You can ask us for a copy of your requests and customer details first.
• We delete your account data within [90 days] of closing, except what we must keep by law (for example, invoices for 6 years).
• We can end your account with 30 days’ notice. We can end it straight away if you seriously or repeatedly break these terms or use LocalMotor unlawfully.

6. Acceptable use

Don’t use LocalMotor to publish anything false, misleading, offensive or unlawful. Don’t impersonate another business, send spam, upload malware, or try to break or overload the service. We may remove content or pause an account that does any of these.

7. Availability

We aim to keep your website and dashboard available at all times, but we can’t promise they will never be interrupted, for example during maintenance or a provider outage. Booking requests and alerts depend on phone networks and email providers we don’t control. Always check your dashboard if you are expecting a request.

8. Our responsibility to you

• Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or anything else the law does not allow us to limit.
• We are not liable for lost profits, lost business, lost bookings or indirect losses.
• Otherwise, our total liability to you in any 12 months is limited to the greater of the fees you paid us in those 12 months and £100.
• You are responsible for claims caused by content you upload or by how you use the service.

9. Changes to these terms

We may update these terms. We will tell you about important changes by email at least 30 days before they apply. If you don’t agree, you can cancel before then.

10. General

• These terms, the Data processing terms and the Privacy notice are the whole agreement between us.
• Neither of us is responsible for delays caused by events outside our reasonable control.
• If any part of these terms can’t be enforced, the rest still applies.
• These terms are governed by the law of England and Wales, and the courts of England and Wales decide any dispute.
